XForce Galaxy Terms and Conditions

Welcome to XForce Galaxy (“XForce Galaxy,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, booking platform, in-person escape room experiences, events, gift cards, merchandise, and all related services (collectively, the “Services”).

By accessing our website, booking a game, purchasing a product, signing a waiver, or participating in any XForce Galaxy experience, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Agreement to Terms

These Terms constitute a legally binding agreement between you (whether personally or on behalf of an entity) and XForce Galaxy.

By using our Services, you represent and warrant that:

  • You are at least 18 years old, or
  • If under 18, you have parental/guardian consent and supervision;
  • All information you provide is accurate and complete;
  • You will comply with all applicable laws and these Terms.

We reserve the right to modify these Terms at any time. Continued use of our Services after updates constitutes acceptance of the revised Terms.

2. Description of Services

XForce Galaxy provides:

  • In-person cybersecurity-themed escape room experiences;
  • Group and corporate events;
  • Ticket sales and bookings;
  • Gift cards and merchandise;
  • Website content and related materials.

We may modify, suspend, or discontinue any aspect of the Services at any time without liability.

3. Eligibility & Group Bookings

3.1 Individual Participants

Participants must meet minimum age requirements for specific games (as posted). Minors may require a guardian’s signature on liability waivers.

3.2 Group & Corporate Bookings

If you book on behalf of a company, school, or organization:

  • You represent that you are authorized to bind that entity.
  • The organization is responsible for the conduct of its participants.

3.3 Accounts

If you create an account:

  • You are responsible for maintaining its confidentiality.
  • You may not access another user’s account.
  • We may suspend or terminate accounts at our discretion.

4. Waivers, Safety & Assumption of Risk

Participation in escape room experiences involves:

  • Physical movement,
  • Confined spaces,
  • Lighting effects,
  • Interactive props and equipment.

By participating, you acknowledge and voluntarily assume all risks associated with participation, including risk of injury.

You are required to sign a separate Liability Waiver and Release prior to participation. Refusal to sign may result in denial of entry without refund where permitted by law.

You agree to:

  • Follow all safety instructions;
  • Respect staff instructions;
  • Avoid reckless or disruptive behavior.

We reserve the right to remove any participant for unsafe or inappropriate behavior without refund.

5. Fees, Payments & Refund Policy

5.1 Pricing

All prices are listed in U.S. Dollars and are subject to change without notice. Taxes and service fees may apply.

5.2 Payments

Payments are processed via third-party processors. We do not store full payment card information.

5.3 Refunds & Rescheduling

Our cancellation and rescheduling policy is posted on our website and incorporated into these Terms. Generally:

  • Full payment required at the time of booking to secure the slot.
  • Cancellations allowed up to 24 hours before the scheduled game time for a full refund or free reschedule.
  • Rescheduling allowed up to 12 hours prior to the game (subject to availability).
  • No refunds for cancellations made within 24 hours of the scheduled time.
  • Late arrivals may result in reduced game time, and entry may be denied after a defined grace period (e.g., 15 minutes).
  • In the rare case of technical issues or operational disruptions from our side, guests will be offered a full refund or reschedule option.

5.4 Gift Cards

  • Gift cards do not expire unless required by law.
  • Not redeemable for cash except where required by law.
  • Lost or stolen cards may not be replaceable.

6. Intellectual Property

All content on our website and within our facilities, including:

  • Game designs,
  • Storylines,
  • Logos,
  • Branding,
  • Graphics,
  • Software,
  • Audio/visual elements,

are the exclusive property of XForce Galaxy or its licensors.

You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use only.

You may not:

  • Copy, reproduce, distribute, or exploit any content;
  • Reverse engineer game elements;
  • Record or disclose game puzzles or solutions publicly.

7. Acceptable Conduct

You agree NOT to:

  • Damage or tamper with property;
  • Reveal puzzles or game secrets publicly;
  • Use the Services for unlawful purposes;
  • Harass staff or other participants;
  • Engage in abusive, threatening, or discriminatory conduct;
  • Attempt to hack, scrape, or disrupt our website systems.

Violation may result in removal, permanent ban, and legal action.

8. User Submissions & Feedback

If you submit:

  • Reviews,
  • Photos,
  • Videos,
  • Testimonials,
  • Suggestions or feedback,

you grant XForce Galaxy a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such materials for promotional or business purposes.

You represent that:

  • You own or have permission to submit such content;
  • It does not violate third-party rights.

9. Third-Party Services

Our Services may contain links to third-party websites (e.g., booking platforms, payment providers). We are not responsible for their content, policies, or services.

Use of third-party services is at your own risk.

10. Privacy

Your use of our Services is subject to our Privacy Policy, which is incorporated by reference into these Terms.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
  • WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
  • WE ARE NOT LIABLE FOR ACTIONS OF OTHER PARTICIPANTS.

Participation is voluntary and at your own risk.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • XFORCE GALAXY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
  • IF NO PAYMENT WAS MADE, LIABILITY SHALL NOT EXCEED $100 USD.

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum permitted by law.

13. Indemnification

You agree to indemnify and hold harmless XForce Galaxy, its employees, officers, affiliates, and agents from any claims, damages, losses, liabilities, and expenses arising from:

  • Your participation;
  • Your violation of these Terms;
  • Your misconduct;
  • Your violation of third-party rights.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

15. Dispute Resolution & Arbitration

15.1 Informal Resolution

Before filing any claim, you agree to contact us and attempt good-faith resolution for at least 30 days.

15.2 Binding Arbitration

Except where prohibited by law:

  • Disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).
  • You waive the right to a jury trial.
  • No class actions or class arbitrations permitted.

Arbitration shall take place in Dallas County, Texas.

If arbitration is unenforceable, disputes shall be resolved exclusively in state or federal courts located in Texas.

Any claim must be brought within one (1) year after it arises.

16. Electronic Communications

You consent to receive communications electronically. Electronic signatures and records are legally binding.

17. Termination

We may suspend or terminate access at any time for violation of these Terms.

Upon termination, you must cease all use of our Services.

Sections relating to liability, indemnification, dispute resolution, and intellectual property survive termination.

18. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including:

  • Natural disasters,
  • Pandemics,
  • Government actions,
  • Power outages,
  • System failures,
  • Supply chain disruptions.

19. Severability

If any provision is deemed unenforceable, the remaining provisions remain in effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any signed waivers, constitute the entire agreement between you and XForce Galaxy.
